By using our Website and by providing us with your personal information, you consent to the collection, use, processing and disclosure of your personal information in accordance with this Privacy Policy and our Website Terms and Conditions. If you do not agree with any terms of this Privacy Policy or our Terms and Conditions, please do not use this Website or submit any personal information.

As used in this Privacy Policy, “personal information” means any information about an identifiable individual, but does not include information that is used for the purpose of communicating with an individual in relation to their employment, business or profession (e.g., name, title, work address, work telephone number, work fax number or work electronic address).

We may also collect and use personal information for other purposes which are disclosed to you, and to which you consent (whether expressly or by implication by providing us with your personal information with knowledge of how we intend to use it), or to meet our legal obligations. For example, we may collect and use personal information to:

- establish, maintain and improve our customer relationship with you and provide you with offers, incentives, marketing programs or promotional material about us and our automotive products and services, such as brochures and newsletters;
- more effectively market to you our vehicles, vehicle parts, accessories and services by better understanding your automotive product and service needs and preferences;

- compile aggregate data for internal and external business purposes and generate and review reports and data about our customer and service usage patterns;

- assist our retailers to meet your automotive product and services needs such as providing you with offers, service reminders, marketing programs or promotional materials; and

We may also collect and/or use personal information without your consent for purposes that are permitted by applicable law, including but not limited to meeting our legal obligations, assisting in the investigation of a breach of an agreement or a law, assisting in law enforcement purposes, and protecting the business interests of JLR Canada and our customers.

JLR Canada also collects such personal information in our marketing efforts on third party websites. JLR Canada may purchase such personal information from reputable third party vendors who provide us with reasonable assurances as to their compliance with applicable privacy laws, including ensuring that the form of consent that is required by law has been obtained. We may collect a list of names and addresses, which may include your name and address where the provider of the list has obtained appropriate consent, from list vendors to send promotions or product information to the names on the list.

We also have relationships with third parties with whom we conduct joint marketing activities such as contests, through which we may obtain your name and address and other information about you with your consent. These activities clearly identify the other parties involved and provide information about their privacy practices. Additional Ways that Information is Collected

Browser Log Files

Our servers automatically log each visitor to the Website and collect and record certain information about each visitor. We use this information to perform analytics on user experience while using the Website and to improve the functionality of our Website to better meet user wants and needs. This information includes or may include your “Internet Protocol”, or IP, address, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks. The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website.

Cookies

From time to time, JLR Canada and/or our advertisers or other third parties may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive and that can be re-sent to the serving website on subsequent visits. A cookie, by itself, cannot read other data from your hard disk or read other cookie files already on your computer. A cookie, by itself, does not damage your system. We, our advertisers and other third parties may use cookies to identify and keep track of, among other things, those areas of the Website and third party websites that you have visited in the past in order to enhance your next visit to the Website or, in the case of our third party advertiser Xaxis, Inc., to provide you with online advertising and to customize the sort of advertisements it provides you. You can choose whether or not to accept cookies by changing the settings of your Internet browser, but some functionality of the Website may be impaired or not function as intended. See the Third Party Opt Out section below.

Web Beacons

Some of our web pages and electronic communications may contain images, which may or may not be visible to you, known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third party advertisers. These Web Beacons do not carry any personal information and are only used to track usage of the Website and activities associated with the Website. See the Third Party Opt Out section below.

Unique Identifier

We may assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Website and some of the electronic communications you receive from us. We keep this information for our internal use, and this information is not shared with others.

Third Party Opt Out

We may allow third-party companies to serve advertisements and/or collect certain anonymous information when you visit the Website. When you visit our Website, we will notify you regarding this collection of anonymous information, ask whether you accept such collection, and provide you with information on how to opt out of such collection. These companies may use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to the Website in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use a cookie or third party Web Beacon to collect this information, as further described above. Through these technologies, the third party may have access to and use non-personalized information about your online usage activity.

You can opt-out of our online behavioral services through any one of the ways described below (you don't need to go to each opt-out site, one is sufficient). After you opt-out, you will continue to receive online advertisements, but those advertisements will no longer be as relevant to you.

- On the Ads that are served by us, you can opt out by using the “Ad Choices” option on our Ads. More information about Ad Choices is available at: http://youradchoices.ca/.

- You can use the opt out instructions provided by our Xasis in its privacy policy available at: https://www.xaxis.com/privacy-policy/.

As a result, this information may be subject to the laws of those jurisdictions, including access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.

We may also share personal information with our financial service providers that we may retain from time to time, who may use this information to contact you regarding the administration of your lease and in furtherance of our marketing purposes.

We require that parties to whom we transfer information agree to process such information in compliance with our Privacy Policy or in a similar, industry-standard manner and to only use personal information we transfer to them for the purposes of the services they provide us and consistent with the purposes for which we may use that information ourselves, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures. The use of your information by one of our identified trusted third-party business partners also may be subject to that party’s own Privacy Policy.

Employment Opportunity Information Collection

For individuals interested in job opportunities with JLR Canada, the Website links prospective employees to a partner’s website. The partner’s website, which has its own Privacy Policy, collects personal information from prospective employees for human resources recruitment purposes. This information is then shared with JLR Canada’s human resources department and others within JLR Canada who are involved in the recruitment process.

Information From Children

The Website is not intended or designed to attract children under the age of thirteen (13). We do not collect personally identifiable data from any person that we know to be under the age of thirteen (13). You affirm that you are either of the age of majority in your jurisdiction of residence, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy. In any case, you affirm that you are over the age of 13, as THE WEBSITE IS NOT INTENDED FOR CHILDREN UNDER 13 THAT ARE UNACCOMPANIED BY HIS OR HER PARENT OR LEGAL GUARDIAN.

Parents should be aware that JLR Canada’s Privacy Policy will govern our use of personal data, but also that information that is voluntarily given by children – or others – in e-mail exchanges, social media, online forums or the like may be used by other parties to generate unsolicited communications. JLR Canada encourages all parents to instruct their children in the safe and responsible use of their personal data while using the Internet. If you are the parent/legal guardian of a child who has provided us with personal information, you may contact us using the contact information provided below for the purpose of deleting this information.

Third Parties and Links

The Website may contain various links to other websites, including links to various third party service providers. JLR Canada is not and cannot be responsible for the privacy practices or the content of any of those other websites. Other than under agreements with certain reputable organizations and companies, and except for third party service providers whose services you voluntarily elect to utilize, we do not share any of the personal information that you provide to us with any of the websites to which the Website links, although we may share aggregate, non-personally identifiable data with those other websites. Please check with those websites in order to determine their privacy policies and your rights under them.

Each retailer operation is a separate legal entity, independent from JLR Canada. As such, each retailer has its own privacy practices and JLR Canada is not responsible for these privacy practices. We recommend that you review the privacy practices of the retailer with whom you are dealing to ensure that you understand their privacy practices and procedures.

European Union Users

If you are visiting us from the European Union, please note that we may transfer your personally identifiable data outside the European Union for use for any of the purposes described in this Privacy Policy. By using the Website and providing the Company with your personal data, you consent to such transfer of your personal data.

Access and Correction

To access your personal information in the possession of JLR Canada and correct inaccuracies of that information in our records, please contact us in the manner specified at the end of this Privacy Policy. We ask individuals to identify themselves and the information requested to be accessed and amended in processing such requests, and we may decline requests in limited circumstances as permitted by applicable privacy legislation.

Your Consent To This Privacy Policy/Withdrawal of Consent

By using the Website and otherwise providing your personal information to us, you consent to the collection, use and disclosure of information by us as specified above, in compliance with this Privacy Policy and the applicable law, unless you inform us otherwise by means of the procedure identified below. If we decide to change this Privacy Policy, we will make an effort to post those changes on this web page so that you will always be able to understand what information we collect, how we use that information and under what circumstances we may disclose that information to others. Your use of the Website or provision of personal information to us following any amendment of this Privacy Policy will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future. We may use comments, information or feedback that you may submit in any manner that we may choose without notice or compensation to you.

You have the right to withdraw your consent for us to collect, use and disclose your personal information. There are some uses from which you cannot opt-out, such as our use of your personal information in connection with your ownership status of a vehicle or vehicle recall (and similar) notification procedures, which are uses that are required by law. In other circumstances, if you withdraw consent, we will not be able to continue with a particular transaction. For example, opting out of the disclosure and use of your personal information as a prospective employee may prevent you from being hired as an employee by JLR Canada to the extent you are using this Website to apply for an open position.

If you withdraw consent, such withdrawal does not operate retroactively and may affect your ability to use our Services.

You may opt out of online behavioral advertising by following the instructions set forth above under the above section “Additional Ways That Information Is Collected,” subsection “Third Party Opt Out.” We may also provide opt out options within electronic marketing or other communications.

If you would like to withdraw consent, or if you have additional questions or comments of any kind, or if you see anything on the Website that you think is inappropriate or incorrect, please let us know by e-mail or by sending your comments or requests to:
